Analýza ukazuje, jak soudci nakládají s hypoteticky formulovanými výroky při interakci s advokáty a jak jejich formy a funkce přizpůsobují svému publiku. Výsledky potvrzují, že hypoteticky formulované výroky v různé míře odrážejí hodnocení soudců. eng Hypotheticals and judicial reasoning in US Supreme Court oral arguments This chapter investigates the use of hypotheticals, or hypothetically framed utterances (HFUs), at US Supreme Court oral argument and it makes two central claims. First, it posits that HFUs reflect genre efficiency and Supreme Court justices’ genre awareness. Second, it argues that HFUs are used as tools for biased sensemaking and public stance-taking, and not as neutral information-gathering devices. The study uses evidence from the oral argument in Morse v. Frederick (2007), a First Amendment case concerning freedom of speech at a school-supervised event. Combining discourse analysis, genre theory and the (biased) sensemaking approach, the analysis reveals how the justices manage HFUs when interacting with the advocates and how the forms and functions of HFUs are attuned to the justices’ audience. The justices’ use of HFUs is additionally discussed in relation to the arguments advanced in the majority and separate opinions, which demonstrates that HFUs reflect, to varying degrees, the justices’ commitments and evaluations. Overall, the study highlights the explanatory power of discourse analysis, genre theory and the sensemaking approach, and suggests ways in which they can assist the analysis of Supreme Court justices’ reasoning and discursive behaviour. genre; hypotheticals; judicial reasoning; oral argument; sensemaking; US Supreme Court
